Among the labor rights we act in orientation and defense regarding:

  • Overtime: The worker has the right to receive additional remuneration for hours worked beyond regular working hours, usually with a 50% increase on top of the normal hour value, which can reach 100% in special situations.

  • Termination Rights: In case of termination of employment contract, the employee has the right to receive severance pay, including salary balance, proportional vacation time, and proportionate 13th salary payment, as well as, if applicable, FGTS fine.

  • Additional Hazard and Unhealthiness: Workers exposed to hazardous or unhealthy conditions have the right to additional payments ranging from 10% to 40% of their salary, depending on the severity of the situation.

  • Vacation Time: Every worker has the right to a period of vacation time of 30 days every 12 months of work, with remuneration increased by one-third.

  • FGTS (Pension Fund for Work Experience): The FGTS is an account linked to the employment contract, where the employer must deposit monthly 8% of the employee's salary, which can be withdrawn in situations such as unjustified termination or even for the purchase of real estate.

  • The employee has the right to receive the above-mentioned benefits and others resulting from the employment contract. Therefore, we have specialized team to prepare calculations and labor claims ensuring what is necessary.

  • On the other hand, we are also ready to defend you, employer, who has the right to a thorough analysis of all already collected fees and existence or non-existence of supplementary rights for the employee, avoiding unjust condemnations.
